Terms and Conditions

  1. Confirmation of participation
    • Following submission of the booking form, we will issue an invoice for payment if the booking is considered by us. We reserve our right to reject any booking without reason.
    • Booking is not considered confirmed and accepted unless our invoice is fully paid within the invoice period and the relevant registration documents have been duly executed and submitted to us.
    • We reserve the right to amend the participant’s preferred schedule to an alternative schedule should there not be any availability and/or due to any reason(s) or factor(s) which would not permit us to operate the camp during the preferred schedule as selected by the participant.

 

  1. Amendments and cancellations
    • Changes are not permitted and booking is not refundable unless it is requested by the participant and agreed by us in writing. If the request for change is agreed by us, we will confirm the changes in writing, failing which the changes shall be deemed rejected or not accepted by us. 
    • Should change of date is required by the participant, we will try to accommodate for an alternative date if such availability is available.
    • The participant may cancel his/her booking by providing prior written notice to us of his/her intention to do so, subject to the participant paying to us the below penalty charges:-

No refund will be made if cancellation is made within 30 days from the commencement of camp date. We reserve the right to deduct or set-off directly the foregoing cancellation penalty charges from the camp fee/ invoice payment paid to us.

 

  1. Price and payment
    • The camp fee shall be reflected in the invoice for payment.
    • Full payment of the camp fee shall be made within 5 days in accordance with the details of the invoice.
    • Camp fee shall include the activities, instructors’ charges and specialist equipment.
    • Camp times are Monday to Friday from 8.30am to 4.30pm (Malaysia time).

 

  1. Participation in programs and guardian
    • As the courses and activities at the camp may be physical at times, the participant should ensure that he/she is in good and satisfactory state of health and have a reasonable level of fitness before embarking on the camp and/or its activities.
    • Parents/Guardians shall provide any relevant medical information of the child(ren) to the camp staff and shall notify in advance if there is any disability, limitation, restriction, or allergy potentially affecting the participant.
    • The participant and guardian shall follow all the instructions set out in the safety rules and all instructions to be given or prescribed by the camp staffs before and during the camp.
    • We reserve the right to exclude from any activity(ies) or program(s) any participant/guardian whose behaviour endangers himself/ herself/ themselves or others, or is deemed inappropriate.
    • In the event that the participant fails to comply with the term(s), condition(s), rule(s) and/or instruction(s) prescribed and/or to be prescribed by us or our instructor(s), we reserve the right to terminate the participant’s participation in our program(s) and activity(ies) with no compensation or refund to the participant(s).

 

  1. Indemnity
    • While our instructors and staffs take all reasonable efforts to ensure the participant’s safety at all times during the camp, the participant and his/her parent/guardian acknowledge and agree that the participant shall join the camp at his/her own risk and the participant shall take all appropriate measures and precautions to safeguard his/her own safety as well as his/her personal belongings during the camp.
    • We and our employees shall not be held liable or responsible for damage, loss, illness, accidents, injuries, casualties and/or deaths occur during the camp. The participant and his/her parent/guardian shall waive all and any claims against us and our employees.
    • The participant may subscribe to and maintain a content and adequate insurance policy(ies) in favour of himself/herself at his/her cost and expenses.
    • The participant and the parent/guardian shall keep us indemnified against all actions, damage, loss, injury, claims, demands, costs, expenses and/or liabilities suffered and/or to be suffered by us and/or our employee(s)/ staff(s)/ instructor(s) directly or indirectly arising out of:-

(i)    any act, negligence or omission of the participant and/or the parent/guardian;

(ii)   all damage, loss, accidents, illness, injuries, casualties and/or deaths resulting from the participant’s and/or the parent’s/guardian’s act, omission or negligence;

(iii) all damage or pollution caused to the common property(ies), swimming pool and/or other part(s) of the building, if such damage or pollution is caused by the participant and/or the parent/guardian; 

(iv) any breach by the participant and/or the parent/guardian of the rule(s), regulation(s), law(s), bylaw(s) and/or statute(s) in force;

(v)   any breach or non-observance by the participant and/or the parent/guardian of the rule(s), covenant(s), term(s), condition(s) or other provision(s) stated herein, in our website and/or as may be prescribed by us from time to time; and

(vi) all claims made by any third party(ies) resulting from the participant’s and/or the parent’s/guardian’s act, omission or negligence.  

 

  1. Reservation & Force Majeure
    • Every reasonable effort will be made to complete the course programs, but all courses and activities are subject to weather and operational factor We reserve the sole and absolute right to alter, adjust, withdraw, substitute and/or cancel the program(s) or any part thereof at any time due to weather or other unavoidable condition(s).
    • We shall not be held liable for any failure or delay to perform any obligation(s) in connection with the operation and execution of the camp and/or programs thereof as a result of unforeseen cause(s) beyond our control or the occurrence of force majeure including but not limited to any strike, lock-out, labour dispute, shortages of personnel, Act of God, enemy or hostile government action, riot, civil commotion, threat to safety, fire, earthquake, flood, storm, tempest, nuclear fallout, epidemic, pandemic, outbreak of disease, inclement weather, lockdown, statutory restriction or control imposed by any Act of Parliament, any rule, ordinance, proclamation or order issued by any competent authority affecting the execution of the camp and/or program thereof.
    • We reserve our right to exclude the participant from any program(s) or to terminate the participant’s participation if in our reasonable opinion that the condition or the behaviour of the participant is disruptive, dangerous, inappropriate or incompatible with the general enjoyment and participation of other participants [including but not limited to spread of infectious or contagious disease or illness (such as chicken pox or Covid etc), suspected involvement with illegal drug, threatening behaviour, bullying, theft, vandalism or other illegal or immoral activity].

 

  1. Data privacy
    • All personal information taken during the booking and registration process shall be used for the purposes of processing the participation of the participant in the camp as well for any future communications by our employees, agents and any third parties authorized by us. We reserve the right to disclose and furnish all and any personal information of the participant if required by law or requested by the competent authority(ies) and/or our authorised employee(s)/ instructor(s)/ consultant(s)/ contractor(s)/ partner(s).
    • We do not permit inappropriate or unauthorised use or sharing of images, photos and videos taken during the camp and we reserve all rights to take relevant actions against the participant and/or parent/guardian.  

 

  1. Others
    • The terms and conditions of the camp shall be governed by and construed in accordance with the laws of Malaysia and parties shall submit to the jurisdiction of the Courts of Malaysia.

    • By agreeing to participate in our camp activities and programs, the participant and/or his parent/guardian shall be bound by the terms and conditions stated herein as well as those in our website, and such other rules and regulations to be prescribed by us from time to time.
    • We reserve the right to update or revise the terms and conditions at our sole and absolute discretion at any time, and the participant shall at all time comply with the terms and conditions as set out by us from time to time.
    • The participant acknowledges that he/she does not rely on any statements, representations, warranties or undertakings made by our employee(s) or agent(s) during and/or prior to his/her participation in our camp programs, unless confirmed in writing by us.
    • Any notice or other communication(s) so given shall be in the English language and shall be deemed to be sufficiently served:

(a)   if delivered by personal or courier delivery, on delivery thereof and the receipt thereof has been acknowledged; or

(b)   if sent by facsimile transmission provided that the sender has received a transmission report confirming that the same has been successfully transmitted and the same is followed by delivery by ordinary mail/email; or

(c)   if sent by electronic mail (e-mail) transmission.

  • We may perform any of our obligation(s) or exercise any of our right(s) by ourselves or through our employees, authorised agents, affiliates, contractors and/or sub-contractors.
  • Any term, condition, stipulation, provision, covenant or undertaking herein which is held invalid or unenforceable by law shall be ineffective to the extent of such invalidity or unenforceability without invalidating the remaining provisions hereof, and any such invalidity or unenforceability shall not invalidate or render illegal, void or unenforceable any other terms, conditions, stipulations, provisions, covenants or undertakings contained herein.
  • Interpretations

(i)    Words importing the masculine gender shall be deemed to include the feminine and neuter genders and vice versa and words importing the singular number shall include the plural and vice versa. Words applicable to natural persons shall include any body of persons corporate or unincorporate and vice versa.

(ii)   The headings herein are inserted for convenience only and shall not form part of the terms herein.

(iii)  “we”/ “our”/ “us” means and shall be interpreted in relation to Outdoor Kicks Sdn Bhd, or the camp organizer of Great Bruton Camp, as the case may be.
